TURBO DIAMOND KENNEL
SALES AGREEMENT
This contract made and entered into on this day ____________________ to TURBO DIAMOND KENNEL is to be referred to as "seller", and ________________________ is to be referred to as "buyer". The for said parties mutually agree upon said pup being of UKC and ADBA, NKC, CKC,APBR registration due to breeding of ________________________(sire) and _______________________________( dam), Born on _____________. The buyer is to pay a deposit the sum of $__350.00_______ for the assurance of said pup leaving a balance remaining of $_______________ due 9 weeks from for said date of birth, if shipping is required; though 8 weeks from to 16 weeks.
Conditions of Sale
1. Both buyer and seller acknowledge that no representations, verbal or implied, have been made with regards to said dogs future abilities (i.e. size, color, fertility, etc.)
2. Seller warrants, to the best of his/her ability that said dog is sound and free from disease. Buyer has the option to take puppy within 24 hours of purchase date, at their own expense, to a veterinarian of their choice. If puppy is found to have a life threatening illness within six months of age, seller will replace the pup from the next available litter equal to current breeding litter, otherwise if no equal breeding or litter is available, you can either chose to pay difference on puppy of greater value or wait until another breeding occurs. An adverse health report must be received in writing and signed by a licensed veterinarian stating that condition is life threatening and untreatable (excluding skin or coat problems). Any treatable condition does not apply.
3. Puppy is guaranteed to qualify for registration with UNTIED KENNEL CLUB (UKC) and AMERICAN DOG BREEDER ASSOCIATION (ADBA) and (NKC) and (CKC) and (APBR) If pup is shipped a health certificate will be provided, registration papers will be sent certified by mail, not with the pup. Confirmation of delivery will be required. If pup is picked up, buyer will receive registration papers and a complete health record at that time. If pup is to be picked up, it must be by the buyer on record. 4. The buyer further understands and agrees that mistreatment or fighting of any kind is punishable by law and at no point will be said pit bull be introduced to such circumstances by buyer or anyone in relations to buyer (friend, relative, or acquaintance).
5. If shipping is required. Shipping charges, including crate, airfare, health certificate, first set of shots, etc., must also be received by the 9th week from pup's date of birth. Airfare is $300 dollars; this is not the required price for an adult dog. Both parties will agree upon a date and time for shipping according to the airlines schedule. Only pups paid in full will be shipped. If all money are not received by the 9th week from the pup's date of birth, then all money are forfeited. No transfer or refund will be awarded.
DEPOSIT
1. Buyer understands that by sending the deposit, this represents a full understanding and agreement to the above-mentioned conditions. Buyer will be required to reply by email that such terms and conditions are agreed upon.
2. Under no circumstances will a deposit be refunded. Deposits can only transfer to another litter. If chosen litter is of greater value the said buyer agrees to pay the complete difference after deposit is applied.
3. If buyer declines pup for any reason, be advised that deposit can only be transferred to another litter or forfeited.
4. It is the buyer's responsibility to make sure that the seller has complete and accurate information to be able to contact buyer regarding payment and updated on pups. Seller will not make an attempt to find buyer if unable to locate buyer after reasonable attempts according to seller, at which point buyer's requested pup will be sold and buyer will receive no reimbursement regarding any money put toward requested pup or adult dog.
5. the buyer will recieve a dog deposit receipt when the deposit is made. the deposit payment to seller will only be cash or postal money order.
PAYMENT
Seller will only accept all cash ,postal money orders, or Western Union Money Transfers or money gram. No personal checks will be accepted. Buyer can make payments toward pup, this is not required; however pup must be paid in full by the 9 weeks from the date of pups birth if being shipped, or no shipping is required.
Seller does suggest that money be sent certified requiring signature upon delivery for buyer's assurance as well as seller. Please contact for mailing address at turbodiamondkennel@yahoo.com.
This contract represents the entire agreement between the buyer and seller. No other agreements or promises, verbal or implied, are included unless specifically stated in writing.
